Terms and Conditions

1.- SCOPE OF APPLICATION

These General Terms and Conditions apply to all OISE programmes. The teaching provided during OISE courses leads to the award of an OISE certificate. These General Terms and Conditions have been drawn up in accordance with: (i) Royal Legislative Decree 1/2007, of 16 November, approving the Consolidated Text of the General Law for the Protection of Consumers and Users; (ii) the legal regulations applicable to non-regulated education; and (iii) other applicable regulations. The specific conditions for each course, which shall be binding on the parties, shall be detailed on the website.

2.- REPRESENTATION

The services related to language courses are organised and provided by Instill Education Limited (trading under the name ‘OISE’), a company registered in England and Wales under company number 01293463, with registered office at OISE House, 38 Binsey Lane, Oxford, OX2 0EY, UK, which is the organiser and is solely responsible for all programmes. ACE Consultores de Idiomas SAU, a Spanish company with registered office at c/ Zurbano 45-1, 28010 Madrid, and Tax Identification Number (NIF) A/78196136, is the marketing name adopted by OISE in Spain and acts solely and exclusively as a promoter on behalf of Instill Education Limited, although it is a registered company. References in this contract to OISE are understood to refer to the Spanish company ACE Consultores de Idiomas SAU, which is covered by the applicable Spanish legislation in force.

3. REGISTRATION AND CONTRACT

Registration may be completed by submitting the Enrolment Form provided by the sales agency, duly filled out in all fields and signed by the student or, if the student is a minor, by their parents or legal guardians, along with a €400 deposit. The Enrolment Form alone is not sufficient to confirm the student’s place on the course. OISE will take the necessary steps to obtain confirmation of the student’s place. Within 14 calendar days of receiving the registration form, OISE will send confirmation of the placement by email once the reservation deposit has been paid, indicating the prices of the services listed on the registration form and the corresponding invoice. At this point, the services will be deemed contracted. The contracting party has 14 days from the date of reservation confirmation to notify OISE of any errors in the reservation details. Once this deadline has passed, the data will be deemed validated, and any changes to it that may incur fees will be the responsibility of the contracting party. If the spot cannot be confirmed, the amount paid will be refunded. The participant has 14 calendar days to withdraw from the product without providing any justification, starting from the date of the reservation (course registration). To effect such withdrawal, the participant must notify OISE of their decision to withdraw from course enrolment by means of an unequivocal written statement. In the event of withdrawal by the participant, OISE will refund to the participant the amounts received from them to date, by crediting the same method of payment used, within no more than 14 calendar days from the date OISE is informed of their decision.

4. PRICE

The price of the courses will be detailed in the information published on the website or in the advertising catalogue, and will be specific to each course. The course price includes:

  • Language course abroad at the chosen destination: classes and teaching materials to be used. The total number of teaching hours will vary depending on the course chosen.
  • Unless otherwise specified in the catalogue, accommodation with a local family (half-board at adult schools and full-board at youth schools).
  • Unlimited internet access at the OISE academic centre.
  • Digital learning resources
    Student placement tests (and progress tests in the case of schools for young learners)
  • Academic transcript and OISE course certificate
    The course price does not include: (i) round-trip flights from the national point of departure; (ii) visa processing or other bureaucratic documentation required for the student to enter the destination country; (iii) academic materials; (iv) guaranteed internet access in accommodation when it is not on the school campus; (v) official language exam fees; (vi) program price adjustments, whether upward or downward, resulting from currency fluctuations; (vii) optional services (optional excursions, meals beyond those specified, alternative accommodation options, among others). OISE operates under a commercial policy free of promotions, discounts, or other incentive-based sales techniques.

5. PAYMENT AND BILLING TERMS

The €400 deposit to reserve the course must be paid in full at the time of registration. Otherwise, OISE is not obligated to provide any services to the student. OISE will provide the student with a supporting document showing the amount paid by the student, the item covered, and the outstanding balance. The full course fee must be paid in full 30 days prior to the scheduled departure date; OISE may cancel the course if payment has not been received. If you book an OISE course less than six weeks before the start date, the transfer must cover the full amount of the services contracted; the €400 deposit will not be sufficient to reserve the course and will not apply in such cases.

6. PAYMENT METHODS

Payment for the course must be made by bank transfer, using the details provided by the sales office. It is essential to email OISE proof of the transfer, indicating the participant’s name and the selected course. All payments must be made in the official European currency (€), in accordance with the prices listed in the OISE official catalogue and on its website.

7. CANCELLATION POLICY

Before the start of the course:

If the student cancels the course at least 14 calendar days in advance, OISE will retain the €400 deposit. If the student cancels the course less than 14 calendar days in advance, OISE will retain the equivalent of one week’s tuition, and the remainder will be duly refunded.

After the student’s departure from their home country and before the start of the course

If the student unilaterally decides to interrupt the program after departing from their point of origin, they must notify the director of the OISE school in which they are enrolled in writing, providing proof that OISE has received such notice by any legally permissible means. To that end, the OISE office or representative where the payments were made will be responsible for refunding the amounts to the student. If, after the student’s departure from their home country, OISE fails to provide, or determines that it cannot provide, a significant portion of the services stipulated in the contract, it shall seek appropriate solutions, which it shall notify to the student in a verifiable manner to enable the program to continue, at no additional cost to the student and, where applicable, by refunding the student the difference between the services stipulated and those actually provided. The communication sent by OISE to the student must provide proof of receipt. If the student does not provide unequivocal notice of their decision to accept or reject the modifications, it shall be understood that the student has chosen to accept the new terms of the contract, and the provisions set forth in Clause 9 of these General Terms and Conditions of Contract shall apply accordingly.

Once the course has started

If a student withdraws from a course after it has already begun, they must notify OISE in writing at least 10 calendar days before the effective date. As a cancellation fee, a charge equivalent to one week of tuition will be applied, in addition to the cost of the course already delivered. The cancellation fee is calculated based on the number of course weeks completed, not on the number of weeks originally booked. The remaining amount to be refunded will be paid by bank check, which the student will receive at their home address after the originally reserved course has ended. For long-term programs, if a student wishes to be absent from the course for one or two weeks, they must notify the course director in writing at least two weeks before the absence is scheduled to begin. Reimbursement for this type of absence will also be made at the end of the course. OISE shall not be obliged to refund the student if the grounds for termination are those specified in clauses 18 and 19 of these General Terms and Conditions.

Change to higher- or lower-level courses

OISE does not charge administrative fees for changing the type of course. Students who decide to change their original course selection to one of higher value must pay the difference at the time of requesting the change, which will be refunded if the change cannot be made. If the new course is of a lower price, any difference between the original booking cost and the new booking will be refunded on the last day of the course to which the student has requested the change.

8. FLIGHTS

OISE is not responsible for schedule changes, cancellations, or other alterations to flights or other means of transportation used to reach the destination due to technical or weather-related issues, labour disputes, or capacity constraints. Any costs arising from changes to or cancellation of flights due to the contractor’s desire to change the program, destination, start date, or course duration shall be the contractor’s responsibility.

9. MODIFICATION OF THE CONTRACT

(Before the start of the course) If, before the student’s departure from their place of origin, OISE is forced to make a significant change to any essential element (as defined in Clause 4 of this contract) of the agreed terms, it shall immediately notify the student or, where applicable, their legal representatives. The student shall have the right to choose between (i) terminating the contract without any penalty, or (ii) accepting the modification to the contract and any possible impact on the price. If the new program offered is priced lower, OISE will refund the student, where applicable, the price difference in accordance with the contract. The student must notify OISE of their decision, by any durable medium, within three days of being notified of the modification. If you do not notify us of your decision within the specified timeframe, you will be deemed to have accepted the contract modification, including any price changes, and will be bound by the cancellation policy set forth in Clause 7 of this contract.

10. SENDIND INFORMATION PRIOR TO THE START OF THE COURSE

Once the booking has been accepted, OISE will send the student personalised and relevant information based on the course booked, including (but not limited to):

the “student handbook”
For young people, information about their arrival at the destination airport;
When accommodation is with a local family, information about the family (contact details and a brief description).
For adults, a level test as well as a needs analysis.

All information will be sent by email in advance of the student’s departure from their home country.

11. COURSE LEVELS

Before the start of the course, students must take a placement test that, depending on the course, may be administered remotely before the student’s arrival or on the first day of class at the OISE academy. The test will consist of a written section and an oral section, and the results obtained will be used to place the student at the appropriate level. If a class at a given level at an OISE school has few students, OISE reserves the right to combine students from different levels into a single class, never exceeding the limit of four or eight students, depending on the chosen format.

12. ACCOMMODATION

OISE handles student accommodation (according to the options available at each destination). In all destinations and cases, for both young learners and adults, accommodation is reserved from the Sunday before the course begins until the Saturday morning after the Friday it ends, as indicated on the course confirmation invoice. It is the student’s responsibility to book round-trip flights in accordance with these dates, as arriving at or departing from the accommodation before or after the specified dates may result in an additional charge for the student. Any such surcharge will depend on the destination and must be confirmed with an OISE advisor. Students who wish to stay longer without classes to take an official exam will be required to pay an additional fee for each day of their stay. These additional costs are not reflected in the prices listed in the catalogues or on the website, so they should be discussed with an OISE advisor in advance. The photographs of the residences included in the catalogue, as well as on the official OISE website, are examples of some of the available residences. Given the impossibility of including all of them in promotional materials, we kindly ask that they be taken as illustrative examples and that you contact an OISE assistant to confirm the address and features of the residence assigned to your course.

13. HOST FAMILIES, USES AND CUSTOMS

Families may not always conform to the so-called “traditional” model, nor are they necessarily composed of fathers, mothers, and children. The meals provided (type, quantity, and serving times) will be in accordance with the customs of the host country. The host family’s address/name, as well as basic information about their interests and the type of housing, will be provided to students before their departure from their home country, and this may be as late as one week before arrival. The student must adapt to the way of life and customs of the country where the contracted course is held. The standards of conduct in the host countries and, in general, the lifestyle may not be the same as those in the student’s home country, so the student is expected to adapt to the new environment during their stay. Families may live no more than 45 minutes by public transportation from the OISE academic centres where classes are held. For students enrolled in youth programs, transportation from home to school and back will always be covered; this is not the case for adults.

14. THE LESSONS

OISE Languages Abroad lessons last between 60 and 90 minutes, varying for group workshop sessions and the project, and may or may not be taught by native teachers (i.e., teachers born in a country where the language of the course is spoken).

Regarding lesson times, they will be held between 8:00 AM and 5:00 PM, Monday through Friday, with five class days per week.

15. TRANSFERS FROM THE DESTINATION AIRPORT

The student may choose to arrange a transfer service from the arrival airport to their booked accommodation (this service is also available for the return trip). The price of this optional service varies depending on the city of arrival and the destination school. This fee covers administrative costs, communication, the welcome service, and transportation. OISE will not be responsible for delays due to traffic, road construction, or traffic accidents en route. Additionally, if several students are picked up at the same time, waiting times may be affected. The price of the service will be provided by the sales office, based on the airport and arrival time.

16. MEDICAL AND TRAVEL INSURANCE

None of the OISE programs include built-in insurance, so all students are required to have travel insurance coverage that is also valid in the event of medical needs. OISE shall not be held responsible for any events arising from the student’s failure to obtain an insurance policy covering their entire stay for medical and travel needs, and shall therefore be exempt from any liability resulting therefrom. The student (or their parent or legal guardian in the case of minor students) confirms that they hold an insurance policy adequate to the needs described herein by signing this contract.

17. PASSPORT AND VISAS

All students need an individual passport or a valid identity card to travel in Europe. The passport, and the visa if applicable, must be valid for the entire duration of the program. If minors do not have a passport, they will need parental consent issued by the Local Police Station (in Spain) and a sworn translation into the host country’s language. OISE assumes no responsibility for students who do not possess these documents, whose documents are not in order, and/or who are not ready in time for the departure date; therefore, all expenses arising from the cancellation of the contracted program due to non-compliance with the described regulations shall be borne by the student. Likewise, obtaining the personal documentation referred to herein (individual passport, visa, permit, paperwork, etc.) shall be the sole responsibility and at the expense of the student or, in the case of a minor, the parents or legal guardians. OISE assumes no responsibility for the procedures involved in obtaining the documents described herein, nor does it offer any form of sponsorship for their processing. OISE strongly recommends contacting the relevant consulate for personalised, case-by-case advice.

18.  DELAYS AND ABSENCES

Student delays and absences at OISE academic centres will be considered breaches of contract attributable to the student, and will relieve OISE of any obligation to refund any amount for deficient contract performance. Failure to attend all classes may result in not receiving the OISE certificate upon completion of the course.

19. DISCIPLINE

Enrolling in OISE courses implies acceptance of the rules of conduct established by the OISE academic centres at the destination, as well as those of the host family with whom the student will stay, if applicable, and acceptance of the laws of the host country. Any failure by students, during their stay at the destination, to comply with the rules of conduct (including engaging in criminal activities and any behaviour that disrupts the learning environment of classes or damages OISE’s property or that of any fellow student) and/or the laws of the host country, duly substantiated by any legally admissible means of proof, shall constitute grounds for termination of the contract attributable to the student. Termination of the contract for cause attributable to the student shall result in the termination of the contractual relationship and the student’s return to their place of origin at no cost to OISE, without prejudice to compensation for any damages caused.

20. COURSE COMPLAINT

Any differences or complaints that, in the students’ judgement, arise during the course must be communicated in writing to OISE staff at the destination where the course is being held so that they can be resolved before the course ends. OISE will address such complaints with the utmost diligence. Written complaints submitted after the course has ended will be addressed by OISE within a maximum of 90 days from the date of submission.

21. OISE’S RESPONSABILITY 

OISE shall be liable for any damages suffered by the student as a result of OISE’s failure to perform or defective performance of the contract. However, such liability shall cease:

a) when the defects observed in the performance of the contract are attributable to the student;
b) when such defects are attributable to a third party unrelated to the provision of the services stipulated in the contract and are of an unforeseeable or insurmountable nature;
c) when the aforementioned defects are due to force majeure, understood as circumstances beyond the control of the party invoking it, abnormal and unforeseeable, the consequences of which could not have been avoided despite having acted with due diligence; and
d) when the defects are due to an event that OISE, despite having exercised all necessary diligence, could neither foresee nor overcome.

OISE will not be held responsible if the student does not have a visa, whether due to its denial or to delays in the student’s visa application process. It shall be the responsibility of the student, parent, or legal guardian to provide OISE with any relevant medical information about the participant, including allergies and past illnesses that may be relevant. The student shall also be responsible for providing the correct postal address, email address, and telephone number in case OISE needs to send important notifications, and shall be required to provide the telephone number of an emergency contact who can be reached at any time, if necessary, during the student’s stay.

22. CONFLICT RESOLUTION

OISE is not responsible for the level of progress students make in the course and is exempt from any third-party claims except in cases of negligence proven in court. Without prejudice to the jurisdiction of the courts and tribunals that, under Spanish law, are competent to resolve any dispute or disagreement relating to the contracted services, the parties may expressly agree that such disputes be resolved in accordance with the Consumer Arbitration System. In the latter case, the parties’ submission to the Consumer Arbitration System is voluntary and must be duly recorded in writing, by electronic means, or in any other legally admissible form that provides evidence of the agreement.

23. DATA PROTECTION

The student and/or the student’s parents or legal guardians are hereby informed, clearly and unequivocally, that the student’s personal data provided, including, where applicable, health data and information relating to the parents or legal guardians themselves, will be incorporated into a mixed file owned by OISE, for the purpose of being processed to the extent necessary or appropriate for the performance of the legal relationship established between the contracting parties. The purpose of this file is to ensure the proper fulfilment and management of our relationship with the student, as well as, where applicable, to keep the student informed about our courses and services that we believe may be suited to their profile, through any means of communication, including electronic channels and, if applicable, newsletters. Both the student and their parents or legal guardians have the right to object at any time to OISE’s use of their personal data to send commercial communications, by contacting OISE through the means indicated below, as well as through the means indicated in each commercial communication that OISE sends. The student and/or the student’s parents or legal guardians are hereby informed of the transfer of personal data to OISE’s partner entities (detailed and up-to-date information on which can be obtained from OISE’s training department), to the extent necessary to comply with obligations established by law or when necessary for the development, performance, and oversight of the legal relationship established between the parties. Likewise, the student and/or the student’s parents or legal guardians expressly and unequivocally consent to the assignment and international transfer of data to other entities within the group to which OISE belongs (and may request detailed, up-to-date information about the entities that comprise and/or are associated with said group and their various activities in OISE’s training department), whether within or outside the territory of the European Union, regardless of whether they offer a level of protection comparable to that established in Organic Law 15/1999 of December 13 on the Protection of Personal Data, to the extent necessary and for the purpose of properly managing the courses administered by OISE. By accepting these general terms and conditions, the student and/or their legal representative consent to OISE’s free use of any photograph, film, or sound recording created during the stay for promotional purposes in which the student’s image appears, and authorise OISE to use their image for the aforementioned purposes, unless otherwise expressly stated in a durable medium recognised by law. Likewise, the free use of material produced by the student and uploaded to social media under the hashtag #beOISE or any other hashtag created or promoted by OISE for advertising and marketing purposes of OISE’s products and services is permitted, and the student grants a free, worldwide license, valid until the material enters the public domain, to the intellectual property rights in such material (i.e., photographs, videos, etc.) so that OISE may use it for such purposes by incorporating it into advertising and/or promotional materials for its products and/or services, which includes reproduction, distribution, public communication (including making it available to the public), and transformation. Both the student and their parent or guardian may, at any time, exercise their rights of access, rectification, cancellation, and objection with respect to their personal data by sending a written notice to OISE Idiomas, OISE House, 38 Binsey Lane, Oxford. Such communication must include your full name, the specific request, an address for notifications, the date, your signature, and a photocopy of your national identity document (DNI) or other valid form of identification.

24. HOLIDAYS

All schools, both for young people and adults, will remain open and operate as normal, unaffected by local, regional, or national holidays, with January 1 and December 25 being the only days of the year on which the group’s schools—open from January to December—will close and offer no services. In cases where a student is affected by any of the closure days, they will be offered makeup class hours during the week or a refund for those hours. Accommodation will be available as normal, unaffected by any holidays on the calendar unless otherwise indicated to the student. In the case of long-term stays where the student chooses to stay with a host family, it may become necessary to change families during the stay, in which case the student will be notified of this need before their arrival.

25. SPECIFIC TERMS FOR CHILDREN AND YOUNG PEOPLE (7–17 YEARS)

25.1.- OISE reserves the right to issue a warning letter for a student’s misconduct and, if there is no improvement in the student’s attitude or behaviour, to send the student home, with all related expenses borne by the parents or legal guardians.

25.2. Furthermore, OISE reserves the right to send a student home without a warning letter or prior notice if the student has committed a serious offence, especially offences involving the police, including theft, smoking in any school building, and the possession, purchase, or consumption of alcohol or illegal drugs.

25.3. For students staying with host families, parents may indicate on the Enrolment Form whether they authorise their child to go out in the afternoons/evenings after classes have ended. That is, without supervision. Generally, this means that children under the age of 13 are not allowed to go out unsupervised after dinner; young people aged 14 and older who have obtained such consent from their parents or legal guardians must always return to the family home before 10:00 p.m. However, students are expected to respect the host family’s house rules, and the family may adjust the curfew if they deem it appropriate (always in favour of an earlier arrival than 10:00 PM). Young participants in residential courses will enjoy activities organised on the premises, and unsupervised outings are not permitted, regardless of age, except in exceptional cases where the student’s family and the school staff reach an agreement to that effect. OISE shall under no circumstances be liable for any incident that may occur while the student is enjoying unsupervised outings.

25.4 – Students aged 18 and over must enrol in an adult school. OISE reserves the right to transfer an 18-year-old from a course designed for young people.

  1. OTHER IMPORTANT TERMS

    26.1. This contract constitutes the entire agreement between the student and OISE with respect to their booking.

    26.2.- OISE may transfer its rights and obligations under this contract to another organisation. OISE will always notify you in writing if this occurs, without affecting the student’s rights or OISE’s obligations under this contract.

    26.3.- This contract is between the student and OISE. No other person shall have the right to enforce any of its terms.

    26.4 Each clause of this Agreement shall operate separately and independently of the others. If any court or competent authority determines that any of them is illegal, the remaining paragraphs shall remain in full force and effect.

    26.5.- If OISE does not sufficiently insist that the student comply with any of their obligations under this contract, or if it fails to enforce its rights against the student, or if it delays doing so, this shall not mean that OISE has waived its rights or that the student is not required to fulfil their obligations, both in accordance with this contract. If OISE waives a breach by the student, it will always notify the student in writing, and such waiver shall not constitute an automatic waiver of any subsequent breach by the student.

    27. Validity of Promotional Material and General Terms and Conditions of Contract

    The information included in the catalogue or on the website and these General Terms and Conditions of Contract are valid from the date of their printing and publication until the printing and publication of the catalogue for the following season or, in any event, until October 1 of this year, at which time the prices and conditions of the OISE programs for the next season must be consulted with an OISE advisor. This information has been edited by OISE and is the property of OISE. The mere act of signing the enrolment application and/or the student’s participation in a course implies the student’s acceptance of and compliance with all the general terms and conditions set forth in this Agreement. All information is correct as of the date of publication, June 2024.
